DMCA TAKEDOWN POLICY

In accordance with the Digital Millennium Copyright Act (“DMCA”), Shemzpalette has adopted the following policy toward copyright infringement.

We reserve the right to block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, or users.

3. FILING A FORMAL DMCA TAKEDOWN NOTICE

If you are a copyright owner or an agent thereof and believe that any content hosted on Shemzpalette infringes upon your copyrights, you may submit a written notification pursuant to the DMCA. To be processed effectively, your “Notice of Infringement” must include the following information in writing:

1. Electronic or Physical Signature: A signature of the person authorized to act on behalf of the owner of the copyright interest.
2. Identification of the Copyrighted Work: A detailed description of the copyrighted work that you claim has been infringed (including URLs to the original source).
3. Identification of the Infringing Material: A description of where the material that you claim is infringing is located on our site (specific URLs of the product pages are required).
4. Contact Information: Your mailing address, telephone number, and official email address.
5. Statement of Good Faith: A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. Statement of Accuracy: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

4. OUR INVESTIGATION & ACTION TIMELINE

Once a valid and complete DMCA notice is received by Shemzpalette, we follow a structured legal protocol:

5. COUNTER-NOTIFICATION PROCEDURE

If you believe that your content was removed by mistake or through misidentification, the DMCA allows you to submit a Counter-Notice. This must be sent to support@shemzpalette.com and must contain:

• Identification of the material that was removed and the location where it appeared before removal.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
• Your name, address, and telephone number.
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Odessa, TX if you are outside the U.S.).

6. REPEAT INFRINGER POLICY

Shemzpalette takes intellectual property theft seriously. In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users, contributors, or account holders who are deemed to be repeat infringers.

7. MISREPRESENTATION AND LIABILITY

Please be advised that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. Filing a false DMCA notice is a serious matter and can result in significant legal costs and damages.
